Apply for Adjustment of Status through Employment

 

Foreign nationals may apply for lawful permanent resident (LPR) status or a green card through employment. Once you are a green card holder, you are entitled to the benefits of a lawful permanent resident of the U.S., including the ability to petition your family for entry to the U.S. and possible naturalization.

 

The road to a green card, however, is complicated. A single inaccuracy in your paperwork or one missing file could derail your application. In some cases, submitting the wrong documents could lead to delays.

Eligibility

The eligibility criteria depend on your preference category. Immigrant workers who may apply to adjust their status include:

 

  • First Preference

    This includes foreign national employees who:

    o Possess extraordinary abilities in the sciences, arts, athletics, education, or business

    o Are outstanding researchers and professors

    o Occupy positions as multinational managers or executives

  • Second Preference

    This includes foreign national employees who:

    o Are professionals holding an advanced degree

    o Possess exceptional ability in the arts, sciences, or business

  • Third Preference

    This includes foreign national employees who:

    o Are skilled workers with jobs requiring at least 2 years of training or experience

    o Are professionals with jobs requiring at least a baccalaureate degree

    o Are other workers or unskilled workers

 

You may also apply for a green card through employment if:

 

  • You are an immigrant investor. To be eligible, you must have invested or currently investing at least $1 million in a new commercial venture in the U.S. (or $500,000 in a targeted employment area). The enterprise must create full-time positions for at least 10 employees.
  • You hold a Physician National Interest Waiver. To be eligible, you must be a physician willing to work full-time in a clinical practice in underserved communities for a certain period.
  • You hold a Religious Worker. To be eligible, you must be either be a minister or a non-minister in religious vocations and occupations who perform religious work in a full-time compensated position for a certain period.
