L-1 Visa Application

 

Employees of an international company who are temporarily transferred to the company’s U.S. office must apply for an L-1 visa. The intracompany transfer involves moving the employee from a foreign office to a parent office, subsidiary, branch, or affiliate in the U.S.

 

The L-1 visa is also issued to multinational company employees sent by their employers to establish an office in the U.S.

 

The L-1 visa has two classifications:

L-1A Visa

The L-1A visa is issued to intracompany transferees who occupy an executive or managerial position in a multinational company outside the U.S. Managers and executives may apply for an L-1 visa for up to seven (7) years.

 

To qualify for an L-1 visa, the employee must:

 

  • Be employed by a multinational company abroad for one continuous year within the last three (3) years before entering the U.S.
  • Be entering the U.S. to provide service as a manager or executive for a branch of the same employer or one of its qualifying organizations

 

L-1B Visa

The L-1B visa is for intracompany transferees who occupy positions requiring highly specialized knowledge in a multinational company outside the U.S. Employees may have an L-1B visa for up to five (5) years.

 

To qualify for an L-1B visa, the employee must:

 

  • Be employed by a multinational company abroad for one continuous year within the last three (3) years before entering the U.S.
  • Be entering the U.S. to provide service in their specialized knowledge capacity to a branch of the same employer or one of its qualifying organizations.

 

Both L-1 visa classifications also allow multinational companies to send employees to the U.S. to establish their affiliated U.S office. Executive or managerial transferees who are sent with this purpose must also prove that:

 

  • The multinational company has secured a physical location for the new office in the U.S.
  • The employee has been employed as a manager, executive, or expert with highly specialized knowledge for one continuous year in the last three years
  • The new office will have a managerial or executive position within a year of the visa approval

Blanket L-1 Visa Option

If multinational companies need to sponsor more than one worker, they may apply for a Blanket L-1 visa. Take note that the organization must meet certain size and volume requirements.

 

Apart from convenience, an approved Blanket L-1 visa may also offer greater flexibility; it may be easier for the multinational company to bring more workers to the U.S. in the future.
