Cancellation of Removal

Lawful permanent residents (LPRs) and non-lawful permanent residents (non-LPRs) who are in deportation/removal proceedings may be eligible for cancellation of removal as a form of relief. Because our clients and their families’ future is at stake, our lawyers handle cancellation of removal proceedings with great care and attention.

Determining Eligibility

The requirements for cancellation of removal differ for LPRs and non-LPRs.

For LPRs. You have to prove that you:

  • Have been an LPR for at least 5 years
  • Have resided in the U.S. for at least 7 years
  • Have no disqualifying criminal convictions

For Non-LPRs. You have to prove that you:

  • Have been physically present in the U.S. continuously for at least 10 years
  • Have displayed good moral character
  • Have no disqualifying criminal convictions
  • Have a U.S. citizen or LPR spouse, parent, or child under 21 years old who will experience “exceptional and extremely unusual hardship” if you were to be removed

Our lawyers will determine your eligibility according to your status. If we assess that cancellation of removal is not an ideal relief in your case, we will advise you and we will explore other forms of defense against deportation.

Burden of Proof

In cancellation of removal proceedings, the LPR or non-LPR bears the burden of proof, which means it is your responsibility to prove your eligibility and convince the Court that you deserve to be granted relief.

Having represented many LPRs and non-LPRs in removal proceedings, our lawyers are well-versed in turning to cancellation of removal as protection from deportation. We will build a strong case for you to obtain a favorable outcome.
