Cancellation of Removal

Lawful permanent residents (LPRs) and non-lawful permanent residents (non-LPRs) who are in deportation/removal proceedings may be eligible for cancellation of removal as a form of relief. Determining Eligibility

 

The requirements for cancellation of removal differ for LPRs and non-LPRs.

 

For LPRs. You have to prove that you:

 

  • Have been an LPR for at least 5 years
  • Have resided in the U.S. for at least 7 years
  • Have no disqualifying criminal convictions

 

For Non-LPRs. You have to prove that you:

 

  • Have been physically present in the U.S. continuously for at least 10 years
  • Have displayed good moral character
  • Have no disqualifying criminal convictions
  • Have a U.S. citizen or LPR spouse, parent, or child under 21 years old who will experience “exceptional and extremely unusual hardship” if you were to be removed
