GREEN CARD, DESPITE PETITIONER’S DEATH AND PREVIOUS DENIAL Jun knew that when a petitioner dies, the petition dies with him.  He also knew there was hope with “humanitarian revalidation.”  Reluctant to spend money, Jun and his family hired another lawyer to work on his humanitarian revalidation case, but got a denial.  When the Survivor Law took effect in 2010, Jun thought he had a second chance at getting his green card.  No longer wanting to take any chances, he hired “attorney-of-last-hope” Michael J. Gurfinkel. The problem was that although Jun was in the US when the petitioner died, he returned to the Philippines, and with the Survivor Law, the beneficiary must continuously reside in the US. With Atty. Gurfinkel’s help, Jun was still able to get his green card.
