REDWOOD CITY, CA. --- The patriarch of the Ambrocio family had to leave his brood behind when he sailed on a ship as a merchant marine, in order to provide for his family. They got news about him only through letters, and years would pass between his homecomings. He worked hard all those years in order to be able to petition his family. Eventually, the rest of the Ambrocio clan was able to arrive in America, except for Jun who had aged out. He was left behind, and had to wait several years for his turn to join his family.

As he patiently waited, Jun hoped that his father’s petition would finally come through for him, but the good news never arrived. In 2008, his dad fell gravely ill, and with a tourist visa, Jun was finally able to see his father, after 17 long years of separation. It was a sad, death-bed reunion though, for after one month and six days, Jun’s father passed. The death of his father meant that his pending petition was automatically revoked, unless USCIS granted his humanitarian revalidation request. Hoping to save money, Jun went to an inexpensive attorney to handle his case. But after a long, frustrating wait, Jun’s humanitarian revalidation request was denied. A dark cloud of despair and hopelessness descended upon the Ambrocio family.

But in 2010, a ray of hope shone through when the Survivor Law was passed. The law provides that a petition survives the death of the petitioner, as long as the beneficiary was in the US at the time of death. This raised the family’s hopes once more, but this time they did not want to take any chances. This was their last card, so they went ahead to consult with the Law Offices of Michael Gurfinkel. While known for being “expensive”, they felt confident that the leading US immigration attorney could see their case through. The Ambrocio family was counting on a triumphant legal process. But the Survivor Law also requires that the beneficiary reside in the US after the peritoner’s death, and Jun had returned home. How would this affect his chances of success?
