THE SEPTEMBER 2007 PRIORITY DATES
Good News for Workers and Married Children

The September 2007 priority dates offer some good news for college graduates and skilled workers, as the priority date for EB-3 petitions went from “unavailable” to August 1, 2002. The priority date for married children of U.S. citizens jumped forward over 6 years from January 11, 1985 to February 15, 1991!

Petitions by Citizens:

The priority date for the First Preference Category, F-1 (unmarried sons and daughters of U.S. citizens, over 21 years of age) moved forward by 14 days, from May 1, 1992 to May 15 1992.

The Third Preference Category, F-3 (married sons and daughters of United States citizens) moved forward by 6 years, one month and 14 days from January 01, 1985 to February 15, 1991.

The Fourth Preference, F-4 (brothers and sisters of United States citizens) moved forward by one month from May 01, 1985 to June 01, 1985.

Petitions by Green Card Holders:

The Second Preference, F-2A (Spouse and minor children (below 21 years old) of green card holder) moved forward by 2 months and 16 days, from July 22, 2002 to October 08, 2002.

The Second Preference, F-2B (unmarried sons and daughters, over 21 years of age, of green card holders) moved forward by 24 days from October 22, 1996 to November 15, 1996.

Petitions by Employers:

The Third Preference (professionals and skilled workers) of Employment-Based Petitions (Labor Certification) moved from “unavailable” to August 1, 2002. Unfortunately, visas for unskilled (“other”) workers are still “unavailable”, meaning no visas are available at the present time. We hope that in October 2007, visa will be available, as that is the start of the visa “fiscal year”, with a new supply/allocation of visas for the coming year.

Each month, the Visa Office of the State Department publishes the priority dates for that particular month. This means that visas would now be available for persons whose priority date is earlier than the cut-off date listed below. If your priority date was “current”, but retrogressed before your immigrant visa was issued (or before you adjusted status in the U.S.), you would have to wait until it becomes current again.

(In August 2007, the priority date was October 22, 1996.)
Third Preference Married sons and daughters of U.S. Citizens February 15, 1991
(In August 2007, the priority date was January 1, 1985.)
Fourth Preference Brothers and sisters of U.S. Citizens. June 01, 1985
(In August 2007, the priority date was May 1, 1985.)


LABOR CERTIFICATION:
Third Preference Professional/Skilled Workers August 1, 2002
(In August 2007, the priority date was unavailable.)
Other workers Non-Skilled Workers Unavailable
(In August 2007, the priority date was also unavailable.)
