LAWYERS CAN HANDLE IMMIGRATION CASES ANYWHERE
by Michael J. Gurfinkel, Esq.
Many people think that in order for an attorney
to represent them with their immigration problems, the attorney
must live in the same city as the client, and/or the client must
travel to the attorney's office to see the attorney in person.
If the attorney's office is out of town, some people rule out
retaining that attorney, no matter how good the attorney may be.
It should be realized that an attorney is not like
a doctor or dentist, who must see their clients (or patients)
in person in order to diagnose the illness. An attorney, on the
other hand, can provide legal advice and services and represent
a client by phone, fax, or mail.
In other words, a person who is eligible to pursue
a greencard either thru Family Petition or Employer Petition,
can hire an out of city or state attorney. The attorney is able
to analyze the immigration problem and represent a client without
personally seeing the client. The attorney could just as easily
mail papers to the client, and the client can mail them back,
regardless of where the client resides. There is no need for the
client to go to the attorney's office to sign forms, or deliver
documents in person.
It does not matter where the attorney's office is located, whether
in Sacramento, Laguna Niguel, San Francisco or Los Angeles, or
anywhere in the United States.
The important thing is for the client to base his choice of attorney
on the attorney's track record of success - - not the attorney's
office location. The client must go to an attorney who is professional,
reliable and trustworthy. Check with friends or relatives who
live near the attorney's office, or relatives and friends who
hired the services of the attorney.
My office represents clients throughout California, such as San
Francisco, San Diego, San Jose, Sacramento, Daly City, etc. and
throughout the United States, such as Nevada, Texas, Florida,
New York, New Jersey, Connecticut, Alaska, Hawaii, etc. for all
kinds of immigration matters, such as employer and family petitions,
deportation, etc. I am able to represent my clients regardless
of which state they reside because immigration law is Federal
law, as opposed to State law and thus, immigration law applies
throughout the United States. For example, an immigration rule
or law is not enforced only in a particular state, but the whole
of the United States, from Hawaii, and the continental U.S. from
the east to the west coast. Once an attorney is licensed to practice
law in any state (i.e. California), he or she is also authorized
to practice immigration law in every single state in the United
States, and is even able to represent clients in any US immigration
matters even if they reside outside of the United States, such
as in the Philippines. The same immigration law is followed by
all U.S. consular offices throughout the world. Therefore, anyone
who is undergoing visa processing, regardless of nationality or
country, may or hire an attorney to help him with his immigration
concerns even if the person is outside the U.S. and the attorney
is in the U.S.
Therefore, if you are looking for an attorney, you
do not have to limit your choices to those located in your immediate
neighborhood. An attorney who is located in a different city or
different state could also be able to help you with your immigration
problems. Mail, fax, and the internet eliminate concerns over
the attorney's location or distance from your home.
