ATTORNEYS CAN HANDLE IMMIGRATION CASES ANYWHERE
IN THE U.S. OR WORLD
by Michael J. Gurfinkel, Esq.
Many people think that in order for an attorney
to represent them with their immigration problems, the attorney
must live in the same city as the client, and/or the client must
travel to the attorney's office to see the attorney in person.
If the attorney's office is out of town, some people rule out
retaining that attorney, no matter how good the attorney may be.
These people do not realize that an attorney is
not like a doctor or dentist, who must see their clients
(or patients) in person in order to provide services.
(A doctor or dentist would need to see the patient in person in
order to diagnose the problem.) An attorney can provide all legal
advice and work by phone, fax, or mail. For example, if a person
wants to obtain a green card through petition by an employer (Labor
Certification), there are a number of governmental agencies that
are located all across the state. The Employment Development Department
is located in Sacramento. The Department of Labor is located
in San Francisco. INS is located in Laguna Niguel.
Do you think that it is necessary for an attorney to have his
office at each of these locations? Of course not. The attorney
is able to mail the appropriate documentation to each of these
locations. Similarly, the attorney could just as easily mail papers
to the client, and the client can mail them back, regardless of
where the client lives. There is no need for the client to come
to the attorney's office to sign forms, or deliver documents.
The important thing is for the client to base his
choice of attorney on the attorney's track record of success -
- not the attorney's office location. The client can ask friends
or relatives, who live near the attorney's office, to check if
the attorney is reputable, or the client can ask friends or relatives
to act in their behalf to deal with the attorney in person. I
am happy to say that even people in San Francisco and other parts
of the U.S. or world have heard of my track record, and want me
to represent them.
My office represents people throughout California,
such as San Francisco, San Diego, San Jose, Sacramento, Daly City,
etc. and throughout the United States, such as Nevada, Texas,
Florida, New York, New Jersey, Connecticut, Alaska, Hawaii, etc.
for all kinds of immigration matters, such as Labor Certification,
family petitions, deportation, etc. The reason I am able to represent
these people, regardless of which state they live in, is that
immigration law is Federal law, as opposed to State
law. That means that the same law about immigration applies throughout
the United States. Once an attorney is licensed to practice law
in any state (i.e. California), he or she is also authorized to
practice immigration law in every single state in the United States,
and is even able to represent clients if they live outside of
the United States, such as in the Philippines.
Therefore, if you are looking for an attorney, you
do not have to limit your choices to those located in your immediate
neighborhood. An attorney who is located in a different city or
different state could also be able to help you with your immigration
problems. Mail, fax, and the internet eliminate concerns over
the attorney's location or distance from your home.
